Bumpy Start to H-1B Season


Online registration for H-1B petitions began with a bumpy start. The online registration portal opened on Sunday, March 1st at 12:00 PM Eastern. Thousands of immigration attorneys and employers logged on to the H-1B portal on Monday to find several glitches and potential filing issues. 

In particular, AILA (American Immigration Lawyers Association) has reported that the online system has a glitch on the G-28, Notice of Entry of Appearance as Attorney or Accredited Representative, which must be completed to register the attorney of record for a particular petition.

When attorneys complete the information for this form, including information about their bar number and law firm information, the finalized PDF version is erroneously showing a box marked that indicates that the attorney is “ineligible to practice law” on the “Eligibility Information for Attorney or Accredited Representative” section. Filing the registration with this error could result in delays or other issues with the application. 

AILA is in contact with liaisons at USCIS about all glitches and widespread issues that attorneys are having with the new registration system. They are actively collecting information on trends from attorneys and are hopeful that USCIS will repair the issues promptly. 

Once online registration is complete, USCIS will assign a confirmation number to each petition which can be used to track the registration. After registration closes on March 20th, USCIS will began randomly selecting petitions and will notify those selected by March 31, 2020.
